Charles James and Designworks filed suit against real estate companies, as well as their affiliates and agents, claiming that defendants infringed their copyrights when they created and published certain floorplans without authorization. The district court granted defendants summary judgment on the infringement claims, as well as on plaintiffs' claims for contributory and vicarious copyright infringement.The Eighth Circuit held that the copyright statute, 17 U.S.C. 120(a), does not provide a defense to a claim of infringement for real estate companies, their agents, and their contractors when they generate and publish floorplans of homes they list for sale. The court reasoned that the terms Congress used in section 120(a) have a certain quality in common—they all connote artistic expression. The court explained that floorplans, like the ones here, serve a functional purpose. The court noted that its decision does not preclude the district court on remand from considering whether some other defense might apply or whether plaintiffs have demonstrated a claim of copyright infringement in the first place. Accordingly, the court reversed the district court's grants of summary judgment to defendants on the primary infringement claim as well as on the claims for contributory and vicarious infringement, vacated the district court's orders awarding defendants costs and attorney's fees, and remanded for further proceedings. Kelley wanted to publish “Hooker to Looker,” to promote her cosmetics business. Di Angelo agreed to publish and distribute Kelley’s then-unwritten Book, with Kelly receiving 50 percent of the net royalties. Kelley provided Di Angelo with a three-page manuscript, detailing her background and outlining the Book’s topics. Di Angelo claims it wrote the Book while “communicating and/or collaborating with Kelley.” The Book Di Angelo distributed lists only Kelley as the copyright holder. Di Angelo sold the initial 1,000-copy print run. Kelley asked Di Angelo for an updated version. Di Angelo alleges that it prepared the updated work, then discovered that Kelley was attempting to work directly with Di Angelo’s printer, in violation of the contract.Kelley sued, claiming that Di Angelo overcharged her and alleging that she “is the sole owner of all copyrights.” Di Angelo counterclaimed for breach of contract. That state court action is pending. Di Angelo filed a federal suit, seeking a declaration that it owns the copyrights. Kelley challenged federal jurisdiction, arguing the claim was premised solely on her alleged breach of the contract, a controversy governed by Texas law. Di Angelo claimed resolution of the authorship dispute required interpretation of federal copyright law, including the definitional and ownership provisions in 17 U.S.C. 101 & 201, which the state court lacks jurisdiction to address. The Fifth Circuit reversed the dismissal of the suit. PersonalWeb’s asserted patents claim priority from an application filed in 1995 and relate to data-processing systems that assign each data item a substantially unique name that depends on the item’s content. These content-based identifiers are generated by a mathematical algorithm, such as a cryptographic hash or “message digest” function. The identifier changes when the data item’s content changes.PersonalWeb sued Google for patent infringement. The court stayed the cases pending resolution of several inter partes reviews (IPRs); the Patent Trial and Appeal Board found all challenged claims unpatentable, concluding that using hash-based identifiers for data management was disclosed in the prior art. The Federal Circuit affirmed. After the stay was lifted, the district court granted Google judgment on the pleadings, citing 35 U.S.C. 101. The 268 patent is directed to seismometers for use in seismic exploration, which generally involves sending an acoustic signal into the earth and using seismic receivers called geophones to detect “seismic reflections” from subsurface structures. Every independent claim of the patent recites, a “geophone internally fixed within” either a “housing” or an “internal compartment” of a seismometer. After being sued for patent infringement, Seabed petitioned for inter partes review of the 268 patent on multiple grounds. The Patent Trial and Appeal Board instituted review and found that the cited prior art did not disclose the geophone limitation and determined Seabed failed to prove the challenged claims were unpatentable. The Federal Circuit vacated. The intrinsic evidence consistently informs a skilled artisan that “fixed” in the claims means mounted or fastened. Given the clarity of the intrinsic evidence, resort to extrinsic evidence is unnecessary. Plaintiffs filed suit alleging that defendants purchased trademark terms as keywords for search-engine advertising, then placed generic advertisements that confused customers as to whether the advertisements belonged to or were affiliated with plaintiffs. Plaintiffs alleged claims for trademark infringement in violation of the Lanham Act and claims under Texas law.The Fifth Circuit reversed the district court's dismissal of the complaint for failure to state a claim, vacated the denial of leave to amend, and remanded for further proceedings. The court agreed with Southwest Recreational, Ninth Circuit precedent, and the author of a leading treatise that in the context of internet searches and search-engine advertising in particular, the critical issue is whether there is consumer confusion and that distraction is insufficient. In regard to plaintiff's trademark infringement claims, the court concluded that whether an advertisement incorporates a trademark that is visible to the consumer is a relevant but not dispositive factor in determining a likelihood of confusion in search-engine advertising cases. America Can! Cars for Kids and Kars 4 Kids are charities that sell donated vehicles to fund children’s programs. America began receiving donations in the late 1980s and, in the early 1990s, began using the mark “Cars for Kids” in advertising campaigns. Kars first used flyers and bumper stickers, then distributed nationwide mailers. In the early 2000s, Kars began other advertising. In 2003, America noticed Kars’ advertisements in Texas and sent a cease and desist letter. America did not notice Kars’ advertisements in Texas for several years. Kars, however, kept advertising, including in Texas, and procured the URL www.carsforkids.com. In 2013, America sent Kars another cease and desist letter. Kars sued in 2014, bringing federal and state trademark infringement, unfair competition, and trademark dilution claims, and seeking equitable relief. America filed suit in 2015, asserting the same claims and seeking cancelation of Kars’ trademark for 1-877- KARS-4-KIDS under 15 U.S.C. 1119, financial compensation, and a nationwide injunction prohibiting Kars from using the mark.The Third Circuit held that America did not preserve its challenge to the denial of summary judgment on its trademark cancelation claims; America was first to use its mark in Texas and Kars waived any challenge to the validity of America’s marks; and the district court did not abuse its discretion by declining to award enhanced monetary relief or prejudgment interest. Life Spine makes and sells a spinal implant device called the ProLift Expandable Spacer System. Aegis contracted with Life Spine to distribute the ProLift to hospitals and surgeons. Aegis promised to protect Life Spine’s confidential information, act as a fiduciary for Life Spine’s property, and refrain from reverse-engineering the ProLift. Aegis nonetheless funneled information about the ProLift to its parent company, L&K Biomed to help L&K develop a competing spinal implant device. Shortly after L&K’s competing product hit the market, Life Spine sued Aegis for trade secret misappropriation and breach of the distribution agreement. The district court granted Life Spine a preliminary injunction barring Aegis and its business partners from marketing the competing product. Aegis argues that the injunction rested on a flawed legal conclusion—that a company can have trade secret protection in a device that it publicly discloses through patents, displays, and sales.The Seventh Circuit affirmed. While public domain information cannot be a trade secret, a limited disclosure does not destroy all trade secret protection. Life Spine did not publicly disclose the specific information that it seeks to protect by patenting, displaying, and selling the ProLift. EWC, which runs a nationwide beauty brand European Wax Center and holds the trademark "European Wax Center," filed suit under the Anti-Cybersquatting Consumer Protection Act (ACPA), against defendant, who used GoDaddy.com to register the domain names "europawaxcenter.com" and "euwaxcenter.com." EWC alleged that defendant registered his domain names with a bad faith intent to profit from their confusing similarity to EWC's "European Wax Center" mark.The Eleventh Circuit affirmed the district court's grant of summary judgment in favor of EWC, concluding that no reasonable juror could conclude that "europawaxcenter" and "euwaxcenter" are not confusingly similar to "European Wax Center" -- they are nearly identical to the mark in sight, sound, and meaning. LBI is the corporate parent of retailers in the apparel and home product field, including Victoria’s Secret entities. LBI’s subsidiaries each maintain their own corporate, partnership, or limited liability company status, identity, and structure. Each Defendant is incorporated in Delaware. The LBI Non-Store Defendants do not have any employees, stores, or other physical presence in the Eastern District of Texas. The Store Defendants each operate at least one retail location in the District. Andra sued Defendants for infringement of the 498 patent, which claims inventions directed to displaying articles on a webpage, including applying distinctive characteristics to thumbnails and displaying those thumbnails in a “master display field.” Andra’s infringement claims are directed to the victoriassecret.com website, related sites, and smartphone applications that contain similar functionality.Defendants moved to dismiss the suit for improper venue under 28 U.S.C. 1406(a), or in the alternative, to transfer the lawsuit to the Southern District of Ohio, arguing that venue was improper because Stores did not commit acts of infringement in the District and the Non-Store Defendants did not have regular and established places of business in the District. The Federal Circuit affirmed the dismissal of the Non-Store Defendants for improper venue. Testimony by one Stores employee supported a finding of the alleged infringing acts in the District. Limited is the assignee of the 180 patent, which is directed generally to a display unit configured to receive video signals from an external video source. Limited sued LG for patent infringement. After the district court granted Limited leave to join Hitachi as plaintiffs to address a standing challenge brought by LG, the case proceeded to trial. The jury found that the accused LG televisions infringed two claims of the patent, that the claims were not invalid, and that LG’s infringement was willful, and awarded Plaintiffs $45 million in damages.In September 2019, the district court denied LG’s post-trial motions regarding infringement, invalidity, and willfulness but ordered further briefing on damages. On April 22, 2020, the district court granted LG’s motion for a new trial on damages. On May 8, 2020, LG filed a notice of interlocutory appeal, seeking to challenge the denials of LG’s post-trial motions regarding infringement, invalidity, and willfulness, all of which were decided in the September Order. LG also challenged the pretrial joinder decision, arguing that, without such joinder, Limited lacked statutory authority to bring suit. The Federal Circuit dismissed for lack of jurisdiction.
